These Terms of Service ("Terms") govern your use of the construction takeoff, estimating, drafting, rendering, shop drawing, and CFS detailing services provided by Utopian TakeOffs LLC ("Utopian TakeOffs," "we," "us"), including our website and client portal. By submitting a project or using our portal, you agree to these Terms.
Utopian TakeOffs provides construction pre-construction services, including but not limited to quantity takeoffs, priced estimates, 2D drafting, 3D renderings, shop drawings, and cold-formed steel (CFS) detailing, produced through a combination of AI-assisted processing and review by our team of estimators and drafters.
You are responsible for the accuracy and completeness of the plans, specifications, and other materials you submit. Deliverables are only as accurate as the information provided — incomplete or outdated drawings may result in an estimate that requires revision once corrected information is available.
You retain all ownership rights to the drawings, specifications, and other materials you upload. Submitting a project to Utopian TakeOffs does not transfer any ownership or licensing rights beyond what is reasonably necessary for us to perform the requested service.
Once a project is paid in full, you may use the resulting takeoff, estimate, drawing, or detailing deliverable for your own bidding, construction, and project purposes. Deliverables are provided as a professional aid to your own bidding and project planning process — they represent our best professional assessment based on the materials provided and are not a guarantee of final construction cost, quantities, or project outcome.
One revision is included free with every delivered estimate, covering corrections and reasonable clarifications within the original scope. Revisions arising from a materially changed scope, revised drawings, or additional trades will be quoted separately as a change order before work begins.
Pay-per-project work is invoiced per the quote provided at submission or upon delivery, depending on the arrangement agreed with you. Recurring plans are billed on a monthly cycle for the agreed volume of projects; submissions beyond your plan's monthly limit may be billed at standard pay-per-project rates or held until the next billing period, at your choice.
We treat all project files you submit as confidential and limit access to personnel assigned to your project. A mutual NDA is available on request. See our Privacy Policy for details on how we handle your data.
To the fullest extent permitted by law, Utopian TakeOffs' liability for any claim arising from our services is limited to the amount paid for the specific project giving rise to the claim. We are not liable for indirect, incidental, or consequential damages, including lost profits or bidding outcomes, arising from the use of our deliverables.
Either party may stop working together at any time. Completed and delivered work remains yours; any outstanding balance for work performed up to that point remains payable.
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law principles.
